You're booked! One last step before your rental. Please read and sign below. By signing you agree on behalf of yourself and everyone you allow to use the sauna (together, the “Users”).
PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. IT IS A RELEASE OF ORDINARY NEGLIGENCE AND AN ASSUMPTION OF RISK.
This agreement is between the person booking and signing (the “Renter”) and Mobile Sauna Therapy and the legal entity that owns and operates it, together with its owners, members, officers, employees, contractors, agents, and successors (the “Released Parties”).
By signing, the Renter agrees on behalf of themselves and everyone they allow to use or be near the rented mobile sauna, trailer, stove, and related equipment, including any cold plunge or contrast-therapy setup provided with the rental (together, the “Equipment”; those people together, the “Users”).
1. Assumption of Risk
Use of a mobile sauna and related Equipment involves inherent and other risks, including but not limited to extreme heat; burns; fire and fire spread to structures, trees, decks, or property; smoke inhalation; carbon monoxide; dehydration; overheating; dizziness, fainting, or cardiac events; slips, trips, and falls (including on stairs, ice, snow, or wet surfaces); equipment or structural failure (including benches, doors, stove, chimney, trailer jack, leveling, or stairs); trailer movement, placement, or instability; property damage; and, in rare cases, serious injury or death. The Renter understands these risks, has had the opportunity to inspect the Equipment and the site, and voluntarily assumes them for themselves and all Users.
2. Full Responsibility for All Users
The Renter is solely responsible for every person who uses or is near the Equipment during the rental, including guests and minors, and agrees to inform all Users of the risks and safety rules, to supervise use, and to ensure any minors are supervised by a responsible adult at all times. The Renter will not permit anyone impaired by alcohol, drugs, or medication to use the Equipment.
3. Health Conditions; Not Medical Care
Sauna use and contrast therapy may be dangerous for people with certain health conditions, including but not limited to heart disease, high or low blood pressure, cardiovascular or respiratory conditions, diabetes, epilepsy or seizure disorders, pregnancy, or recent surgery or illness. This rental is not medical treatment, and the Released Parties are not health-care providers. The Renter confirms that they and all Users have been advised to consult a physician before use, and that no one will use the Equipment against medical advice or while impaired.
4. Release of Ordinary Negligence
To the fullest extent permitted by law, the Renter releases, waives, and discharges the Released Parties from any and all liability, claims, or demands for injury, illness, death, or property damage arising from the rental, delivery, placement, use, or removal of the Equipment, including claims arising from the ordinary negligence of the Released Parties. This release does not apply to gross negligence, willful or wanton misconduct, fraud, or violation of law.
5. Indemnification
The Renter agrees to indemnify, defend, and hold the Released Parties harmless from any claim, demand, or lawsuit brought by the Renter or any User (including minors), or by anyone else arising out of the rental or use of the Equipment, including reasonable attorneys’ fees, except to the extent caused by the Released Parties’ gross negligence or willful misconduct.
6. Rules, Inspection & Safe Use
The Renter agrees to follow all provided safety instructions and operating rules, which are part of this agreement, and to use the Equipment only as intended. The Renter will not leave a lit stove unattended, exceed occupancy or session guidance, or use the Equipment in an unsafe manner. The Renter has received, or will receive before use, a safety briefing and operating instructions, and has had the opportunity to inspect the Equipment.
7. Emergency Medical Care
If a User needs emergency medical care, the Renter authorizes reasonable emergency treatment and agrees the Renter is responsible for all related costs.
8. Unknown Claims (California Civil Code § 1542)
The Renter expressly waives all rights under California Civil Code section 1542, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” The Renter intends to release both known and unknown claims arising from the rental or use of the Equipment, to the extent permitted by law.
9. Acknowledgment
The Renter is at least 18 years old, has read and understood this waiver, and signs it freely, including by electronic signature. This is the entire agreement on liability and assumption of risk; no oral statement changes it. If any provision is found unenforceable, the rest remains in effect. This agreement is governed by the laws of the state where the Equipment is located and used for the rental (California or Nevada), without regard to conflict-of-law rules. Any action shall be brought in the county where that rental occurred.
A signed waiver is required before your rental.
